These Terms explain how Numera® products, services, apps, portals, and monitoring-related features may be used. They also outline important limitations, including device connectivity, fall detection, location accuracy, emergency response, subscriptions, and cancellations
Agreement to these Terms
These Terms of Service explain the rules that apply when you use Numera® websites, products, devices, apps, portals, monitoring services, support services, or related offerings
By using Numera® products or services, you agree to these Terms. If you do not agree, please do not use the products or services
These Terms should be reviewed by legal counsel before publishing
1. About Numera®
Numera® provides personal safety technology, including Libris devices, Home Safety Hub, CareOne™, related apps and portals, professional monitoring connections, device support, and other products and services
Some services may be provided directly by Numera®. Others may be provided through authorized dealers, resellers, monitoring partners, technology providers, or service providers
2. Who may use our services
You may use Numera® products and services only if you are legally able to enter into an agreement and follow these Terms
If you are using Numera® products or services on behalf of another person, such as a parent, loved one, customer, patient, or employee, you confirm that you have the authority to set up, manage, or support the account on their behalf
3. Products and services
Numera® products and services may include:
- Libris personal safety devices
- Home Safety Hub systems
- CareOne™ app and portal access
- Dealer or reseller portals
- Device setup and configuration
- Professional monitoring connections
- Emergency contact and Care Circle features
- Customer support
- Alerts, notifications, and device status features
Available features may vary by device, service plan, region, dealer, monitoring partner, network coverage, and account settings
4. Emergency response and monitoring
Numera® products are designed to help connect users to support during an alert or emergency. Depending on the product, service plan, and setup, alerts may be routed to a Care Center, monitoring partner, emergency services, chosen contacts, or members of a Care Circle
When an alert is triggered, a trained responder may attempt to speak with the user, assess the situation, contact emergency services if needed, and notify designated contacts according to the account’s response protocol
Emergency response times and outcomes may vary based on many factors, including network availability, location accuracy, call connection, emergency service availability, user responsiveness, account information, and local conditions
Numera® products and services do not guarantee that emergency assistance will arrive within a specific time or that every emergency will be detected or resolved
5. Not a medical device
Unless expressly stated otherwise, Numera® products are personal emergency response systems and personal safety devices. They are not medical devices and are not a substitute for professional medical care, emergency medical services, in-person supervision, or direct caregiving
Always call emergency services directly when immediate medical, fire, police, or life-safety assistance is required and you are able to do so
6. Fall detection limitations
Some Numera® products may include fall detection or optional fall-detection features
Fall detection is designed as an added layer of support, but no fall detection technology can detect every fall. A fall may not be detected if the device is not worn properly, is worn loosely, is removed, has insufficient battery, is outside service coverage, or if the movement does not match the system’s detection patterns
Fall detection is not a guarantee and is not a replacement for pressing the help button when you are able to do so
7. Location services
Some Numera® devices and services use GPS, Wi-Fi, cellular, registered address, or other location information to help identify where a user may be during an alert
Location information may not always be available, complete, or accurate. Accuracy can be affected by signal strength, building materials, device placement, network coverage, environment, user settings, and other factors
Location features are intended to support response efforts, but they do not guarantee that responders or contacts will know the user’s exact location
8. Network, power, and service availability
Numera® products and services may depend on cellular networks, GPS, Wi-Fi, Bluetooth, power, batteries, internet services, app stores, third-party systems, and monitoring partners
Service may be interrupted, delayed, limited, or unavailable due to:
- Weak or unavailable cellular signal
- Power outages
- Depleted batteries
- Device damage or misuse
- Network maintenance or outages
- App, portal, or software updates
- Third-party service disruptions
- Incorrect account or contact information
- Environmental conditions
- Events outside Numera’s reasonable control
You are responsible for keeping devices charged, powered, properly worn or placed, and used according to instructions
9. Account setup and information
You agree to provide accurate, current, and complete information when setting up or using Numera® products and services
This may include:
- User name and contact information
- Service address or registered address
- Emergency contacts
- Care Circle contacts
- Medical or care notes, where provided
- Device and account preferences
- Billing and payment information
You are responsible for keeping this information up to date. Outdated or incorrect information may affect alerts, notifications, monitoring, emergency response, billing, or support
11. Dealer and reseller relationships
Some Numera® products and services may be sold, set up, billed, supported, or managed by authorized dealers, resellers, or partners
If you purchase through a dealer or reseller, additional terms from that dealer or reseller may apply. Numera® is not responsible for promises, representations, pricing, promotions, or service terms offered by a third party unless Numera® has expressly agreed to them in writing
12. Purchases, subscriptions, and billing
Some Numera® products and services may require a one-time purchase, monthly subscription, activation fee, service plan, monitoring fee, or other recurring charge
By purchasing or subscribing, you authorize Numera® or its authorized billing provider to charge the payment method you provide for applicable fees, taxes, shipping, and other charges
Subscription fees, included features, billing dates, and renewal terms should be clearly shown at the time of purchase or enrollment
13. Cancellations
You may cancel eligible services according to the cancellation process provided at the time of purchase or through your account, dealer, reseller, or Numera® support
Cancellation does not automatically refund past charges unless required by law or stated in the applicable purchase terms. Some services may remain active until the end of the current billing period
If your service is managed by a dealer, reseller, app store, or third-party billing provider, you may need to cancel through that party
14. Returns and refunds
Returns, refunds, exchanges, and warranty support may vary depending on the product, service plan, purchase channel, dealer, reseller, or region
Please review the return and refund policy provided at the time of purchase or contact Numera® support for assistance
15. Acceptable use
You agree not to misuse Numera® products, services, apps, portals, websites, or systems
You may not:
- Use the services for unlawful, harmful, fraudulent, or abusive purposes
- Interfere with the operation or security of Numera® systems
- Attempt to access accounts, devices, data, or systems without authorization
- Reverse engineer, copy, modify, or tamper with Numera® software or devices
- Use false information when creating or managing an account
- Trigger false alerts intentionally
- Resell, transfer, or commercially exploit services without authorization
- Use the services in a way that violates another person’s rights or privacy
16. Software, apps, and updates
Numera® may provide software, firmware, app, or portal updates to improve performance, security, features, reliability, or compliance
Some updates may be installed automatically. Certain features may change, be added, or be removed over time. Continued use of the services after an update means you accept the updated functionality
17. Intellectual property
Numera®, Libris, CareOne™, and related names, logos, designs, software, content, graphics, icons, images, product designs, and materials are owned by Numera® or its licensors
You may not copy, modify, distribute, display, sell, or use Numera®intellectual property without prior written permission
18. Privacy
Your use of Numera® products and services is also governed by our Privacy Policy. The Privacy Policy explains how personal information is collected, used, shared, stored, and protected
Please review the Privacy Policy carefully
19. Third-party services
Numera® products and services may work with third-party networks, monitoring partners, app stores, payment processors, shipping providers, analytics providers, emergency services, or other service providers
Numera® is not responsible for third-party systems, websites, services, policies, outages, delays, or actions, except where required by law
20. Disclaimers
Numera®products and services are provided on an “as is” and “as available” basis, to the fullest extent permitted by law
Numera® does not guarantee that products or services will be uninterrupted, error-free, available in every location, compatible with every device or system, or able to detect or respond to every emergency
Some jurisdictions do not allow certain disclaimers, so some parts of this section may not apply to you
21. Limitation of liability
To the fullest extent permitted by law, Numera® and its affiliates, directors, officers, employees, partners, dealers, resellers, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, business interruption, emotional distress, personal injury, property damage, or failure of emergency response, except where liability cannot be limited by law
Nothing in these Terms limits liability where it would be unlawful to do so
22. Indemnity
You agree to defend, indemnify, and hold harmless Numera®and its affiliates, directors, officers, employees, partners, dealers, resellers, suppliers, and service providers from claims, losses, damages, liabilities, costs, or expenses arising from your misuse of the products or services, violation of these Terms, or violation of another person’s rights
23. Changes to the services
Numera® may modify, suspend, or discontinue products, services, features, apps, portals, or website content at any time, subject to applicable law and any active customer agreements
24. Changes to these Terms
Numera®may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page
Continued use of Numera® products or services after updated Terms are posted means you accept the updated Terms
25. Governing law
These Terms are governed by the laws of [Province/State] and the applicable federal laws of [Canada/United States], unless another jurisdiction is required by law or specified in a separate written agreement
